Third Appeal

If you have attended your first appeals hearing and presented your case to an ALJ, and you are still being denied SSDI benefits for your physical impairments resulting from your liver disease, you will have the opportunity to appeal your case a third time.  Believe or not, you shouldn’t give up the pursuit of your benefits even if the ALJ denied you during the hearing.  The key difference is that you will need to present this third appeal (which will be scheduled after your initial hearing) to the Appeals Council.

We cannot stress the importance of hiring the services of a qualified and experienced Social Security Disability attorney to help you in the pursuit of your SSDI benefits.  Remember also, that your disability may not just be stemming from your liver disease or disorder.  The medications you are taking to treat your condition may create an inability for you to work and earn a living.  This entitles you to benefits but the burden of proof is always on you, hence the importance of having that attorney’s assistance in the matter.

Here is another consideration.  If you disagree with the date which the ALJ has established regarding when you officially became disabled, and even if you felt that the decision was favorable, you can present these issues to the Appeals Council.  This is also true if you feel there are any other discrepancies involved with your case and its documentation which developed during your appeals hearing.

It is highly advisable that you seek legal counsel before proceeding because the process only becomes more difficult and you will be subjected to lengthy waiting periods before ever being able to present your case to the Appeals Council.  Remember that a Social Security Disability attorney has considerable expertise in these matters, whether it is with prior cases about receiving SSDI benefits due to liver disease or any other medical condition which has disabled you.

The attorney will be well-versed at both the policies and the procedures by which this third appeal is governed.  They are experienced and skilled at presenting your liver disease disability claim to this Appeals Council.  Finally, should you be denied after presenting your case to the Appeals Council, believe it or not, you still have one more opportunity to make a fourth appeal by attending a hearing at a Federal District Court.  In most instances, it is uncommon for appeals to progress to this stage.  However, it is still a consideration.
