Decision Delays
Whether it is a liver disease or disorder which has rendered you physically disabled and incapable of earning a living or some other medical condition, you may still have to attend a Social Security Disability hearing in order to appeal a denial of your SSDI benefits. Once you have gone through the hearing process and are waiting for the ALJ’s decision in your case, you may be waiting a lengthy period of time before you are ever informed of their decision.
The question that oftentimes arises at this point in time is “why does it take so long for the ALJ (and other powers-to-be) to render a decision regarding my case?” First and foremost, always remember that you are dealing with the SSA, a faction of the US Government. The current backlog of pending cases is immense and has resulted in numerous problems, one of which is a delay in receiving the ALJ’s decision.
No matter what your specific liver disease or other medical malady is, you will most likely be subjected to the delays that result by virtue of the government entity that you are dealing with. Other factors leading to a delay in receiving your decision could also be involved, one of which is the efficiencies involved in the writing of opinions regarding your case. Another issue involves the insufficient amount of staff members who handle claims for SSDI benefits.
What is disconcerting here is knowing that you’re the decision in your case could eventually be handed over to an SSA staff member who was not in attendance at your hearing, which is allowed by the SSA. However, we feel this could be detrimental to the ALJ’s decision at approving or denying your SSDI benefits. Since they will be allowed to write the final decision in your liver disease disability case and have no knowledge of what transpired in the hearing, you could still be at risk of losing some much needed SSDI benefits.
Unfortunately, and as things currently stand, there is no solution to this dilemma as yet, whether it is in regards to a disability case about liver diseases or other medical conditions. The bottom line is that you need to realize that this is going to be a very trying process, and without the assistance of an experienced and qualified Social Security Disability attorney, you get could discouraged enough to give up. Don’t do that if you can avoid it. If you are genuinely deserving of SSDI benefits, never give up the fight.
